how common is it to hear a whine from the rear end , is that a sign of its end ?

It's a hawk I'm looking to buy, it's an 02 with stock gears and he says it's a fairly common problem , says the fluid is fine...

How does he know the fluid is fine? How many miles? Does it have the optional SLP differential?
Could be the gears.

If so, it's not really 'common', but it is typical because of not changing the fluid.
Mine had some minimal noise when I first got it with 27k miles on it.
I changed the fluid per recommendations & it was fine after that.
Have done it again since then & it now has about 54k miles on it.
Maybe only 4k since the last change.
I need to find the OE/Firehawk owner's manual somewhere, but it's recommended to change at pretty short cycles/miles if I remember right. (This is in reference to the Auburn option only.)
I don't think I'd agree & let him say "it's fairly common" issue.
It's an issue because of someone not taking care of it properly, IMO.

he says it has done it since 34k when he bought it , and it serviced then and just had it serviced at 49k .... no change

a) If 'No', disregard any further comments.
b) If 'Yes, continue to question #2)
2) Did he use synthetic fluids?
If 'Yes' to both questions, ..., There's the problem.
